1. Introduction

Welcome to Brandeis Swim Lessons. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

2. Services

Brandeis Swim Lessons provides swimming instruction services to individuals of all ages and skill levels. Our services include:

• Group swimming lessons
• Registration and scheduling of lessons
• Instructor assignment
• Online account management

3. Account Registration

3.1 Account Creation

To access certain features of our services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Registration for Lessons

4.1 Booking and Payment

When you register for swimming lessons, you agree to:

• Provide accurate information about yourself and/or the swimmer
• Pay all fees for the lessons booked
• Adhere to our cancellation and rescheduling policies

4.2 Waitlist

If a class is full, you may join the waitlist. Being on the waitlist does not guarantee a spot in the class. If a spot becomes available, we will contact you to confirm enrollment.

5. Class Attendance and Policies

5.1 Attendance

Participants should arrive at least 5 minutes before the scheduled lesson time.

5.2 Cancellations and Exceptions

We reserve the right to cancel classes due to unforeseen circumstances (facility issues, instructor illness, etc.). In such cases, we will provide make-up classes or refunds as appropriate.

5.3 Missed Classes

There are no refunds for missed classes. In certain circumstances (illness, emergency), we may offer the opportunity to make up the class if space permits.

6. Participant Conduct and Safety

6.1 Rules and Guidelines

All participants must follow the safety rules and guidelines provided by instructors. We reserve the right to remove participants from classes for disruptive behavior or safety concerns.

6.2 Health and Ability

You represent that the registered swimmer is in good health and has no physical conditions that would prevent safe participation in swimming lessons.

7. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Brandeis Swim Lessons and is protected by copyright and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Brandeis Swim Lessons shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

9. Indemnification

You agree to indemnify and hold harmless Brandeis Swim Lessons and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website with a new "Last Updated" date.

11. Termination

We may terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of our services or us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
